The storming of the US Capitol building in January 2021 focused attention on the multiple threats facing contemporary liberal democracies. Beyond the immediate problem of Covid-19, the past two decades saw political polarization, a dramatic rise in inequality, global warming and other environmental threats, as well as the growth of dangerous cultural and political divisions. Western liberal democracies find themselves in the midst of what political theorists call a legitimation crisis: major portions of the population lack confidence in the ability of governments to address our most pressing problems. This distrust in government and traditional political parties opened the door to populist leaders and a rising tide of authoritarianism. Liberal democracies face major structural and normative challenges in the near future that require us to look beyond the traditional set of solutions available. Democracy in Crisis points back to the world's first democratic government, Ancient Athens, to see what made that political arrangement durable and resistant to both internal and external threats. The argument focuses on several distinctive Athenian institutions and practices, and considers how we might reimagine them in the modern world. The book addresses questions of civic ideology and institutions, with extended treatment of two distinctive Athenian institutions, ostracism and sortition.

Incorporating important recent work by historians, epigraphists, and archaeologists, Stockton traces thebroad development of the Athenian constitution from the reforms of Solon in the early sixth century to those of Ephialtes in the late 460s B.C., carefully examining the fully-developed democratic system of the post-Ephialtic period. Stockton translates all Greek terms and explains difficult essaysmaking the volume highly accessible to students of ancient and modern history, and to the general reader.

The democratic legal system created by the Athenians was completely controlled by ordinary citizens, with no judges, lawyers, or jurists involved. It placed great importance on the litigants' rhetorical performances. Did this make it nothing more than a rhetorical contest judged by largely uneducated citizens that had nothing to do with law, a criticism that some, including Plato, have made? Michael Gagarin argues to the contrary, contending that the Athenians both controlled litigants' performances and incorporated many other unusual features into their legal system, including rules for interrogating slaves and swearing an oath. The Athenians, Gagarin shows, adhered to the law as they understood it, which was a set of principles more flexible than our current understanding allows. The Athenians also insisted that their legal system serve the ends of justice and benefit the city and its people. In this way, the law ultimately satisfied most Athenians and probably produced just results as often as modern legal systems do. Comprehensive and wide-ranging, Democratic Law in Classical Athens offers a new perspective for viewing a legal system that was democratic in a way only the Athenians could achieve.
Coherence in Psychotic Discourse by
This fascinating study explores the ways of establishing coherence in the discourse of a thought-disordered patient. Ribeiro analyzes the discourse between a doctor and a patient who is under an acute psychotic crisis, and then later, when the patient is deemed recovered. Ribeiro looks at how the participants jointly establish referential meaning, and how topic coherence is achieved or breaks down. She then considers how the participants convey superordinate messages, metamessages, and how the patient signals and assesses the frame of talk. Ribeiro concludes that psychotic discourse, while incoherent on the level of topic, may be coherent on another level--that of frame. Using sociolinguistic discourse analysis, conversational analysis, and frame analysis, with a dose of theory from contemporary cognitive psychology, Ribeiro's book demonstrates the importance of contextualization in interaction.

The definitive book on judicial review in Athens from the 5th through the 4th centuries BCE. The power of the court to overturn a law or decree--called judicial review--is a critical feature of modern democracies. Contemporary American judges, for example, determine what is consistent with the Constitution, though this practice is often criticized for giving unelected officials the power to strike down laws enacted by the people's representatives. This principle was actually developed more than two thousand years ago in the ancient democracy at Athens. In Control of the Laws in the Ancient Democracy at Athens, Edwin Carawan reassesses the accumulated evidence to construct a new model of how Athenians made law in the time of Plato and Aristotle, while examining how the courts controlled that process. Athenian juries, Carawan explains, were manned by many hundreds of ordinary citizens rather than a judicial elite. Nonetheless, in the 1890s, American apologists found vindication for judicial review in the ancient precedent. They believed that Athenian judges decided the fate of laws and decrees legalistically, focusing on fundamental text, because the speeches that survive from antiquity often involve close scrutiny of statutes attributed to lawgivers such as Solon, much as a modern appellate judge might resort to the wording of the Framers. Carawan argues that inscriptions, speeches, and fragments of lost histories make clear that text-based constitutionalism was not so compelling as the ethos of the community. Carawan explores how the judicial review process changed over time. From the restoration of democracy down to its last decades, the Athenians made significant reforms in their method of legislation, first to expedite a cumbersome process, then to revive the more rigorous safeguards. Jury selection adapted accordingly: the procedure was recast to better represent the polis, and packing the court was thwarted by a complicated lottery. But even as the system evolved, the debate remained much the same: laws and decrees were measured by a standard crafted in the image of the people. Offering a comprehensive account of the ancient origins of an important political institution through philological methods, rhetorical analysis of ancient arguments, and comparisons between models of judicial review in ancient Greece and the modern United States, Control of the Laws in the Ancient Democracy at Athensis an innovative study of ancient Greek law and democracy.

Political Dissent in Democratic Athens by
How and why did the Western tradition of political theorizing arise in Athens during the late fifth and fourth centuries B.C.? By interweaving intellectual history with political philosophy and literary analysis, Josiah Ober argues that the tradition originated in a high-stakes debate about democracy. Since elite Greek intellectuals tended to assume that ordinary men were incapable of ruling themselves, the longevity and resilience of Athenian popular rule presented a problem: how to explain the apparent success of a regime "irrationally" based on the inherent wisdom and practical efficacy of decisions made by non-elite citizens? The problem became acute after two oligarchic coups d' tat in the late fifth century B.C. The generosity and statesmanship that democrats showed after regaining political power contrasted starkly with the oligarchs' violence and corruption. Since it was no longer self-evident that "better men" meant "better government," critics of democracy sought new arguments to explain the relationship among politics, ethics, and morality. Ober offers fresh readings of the political works of Thucydides, Plato, and Aristotle, among others, by placing them in the context of a competitive community of dissident writers. These thinkers struggled against both democratic ideology and intellectual rivals to articulate the best and most influential criticism of popular rule. The competitive Athenian environment stimulated a century of brilliant literary and conceptual innovation. Through Ober's re-creation of an ancient intellectual milieu, early Western political thought emerges not just as a "footnote to Plato," but as a dissident commentary on the first Western democracy.

Rural Athens under the Democracy by
Much of the evidence--literary, historical, documentary, and pictorial--from ancient Athens is urban in authorship, subject matter, and intended audience. The result has been the assertion of an undifferentiated monolithic "Athenian" citizen regime as often as not identifiably urban in its lifestyle, preoccupations, and attitude. In Rural Athens Under the Democracy, however, Nicholas F. Jones undertakes the first comprehensive attempt to reconstruct on its own terms the world of rural Attica outside the walls during the "classical" fifth and fourth centuries B.C. What he finds is a distinctly nonurban (and nonurbane) order dominated by a traditional, predominantly agrarian society and culture. Jones relies heavily upon the relatively neglected epigraphic record from the rural countryside and villages, as well as posing new questions of the well-known urban writings of Athenian historians, essayists, and philosophers and occasionally following the lead of Hesiod's agrarian poem Works and Days. From these sources he gleans new findings regarding settlement patterns, argues for a heretofore unrecognized system of personal patronage, explores relations between villages and the town of Athens, reconstructs the "Agrarian" Dionysia in several of its more important dimensions, and contrasts the realities of rural Attic culture with their various representations in contemporary literary and philosophical writings by Aristophanes, Xenophon, Plato, and others. Building on Jones's previous publications on the ancient Greek city-state, Rural Athens Under the Democracy presents the first holistic examination of classical extramural Attica. He challenges the received view that ancient Athens in its heyday was marked by a uniform cultural, ideological, and conspicuously citified order and, in place of the perception of things rural as mere deficits in urbanity, proposes that we look at Attica outside the walls in its own right and in positive terms.
